Interesting new Federal Circuit opinion about standing to sue of a patentee who defaulted on its loan agreement:

TWEET1: IT v Zebra 5/1 holds patentee IT’s loan default gave its secured creditor the *option* to license patent but didn’t auto-divest IT of *all* exclusionary rights. IT still has Art III standing (injury in fact) to sue Zebra for patent infringement. WDTex (Albright) reversed.

TWEET2: NB: does *not* decide the distinct issue whether in default IT is still a 35 USC 281 “patentee” with “statutory standing.” If not, IT could cure this non-jurisdictional defect by joinder (unlike a lack of Constitutional standing).
