Military Law vs Constitutional Law

The Members in the military will be governed based on Military Law the detainees will be governed under Constitutional law. There is not going to be any consequences for behaviors unless it’s unbecoming of a soldier thru Court martial proceedings.

While both are legal frameworks, military law is a separate legal system specifically designed for the armed forces, governed by the Uniform Code of Military Justice (UCMJ), which can sometimes have different interpretations of rights compared to the broader constitutional law that applies to all citizens, allowing for stricter regulations to maintain discipline and readiness within the military; essentially, military law operates under the umbrella of the Constitution but can adapt certain rights based on the unique demands of military service.

Scope:
Constitutional law governs the fundamental rights and powers of the government as outlined in the U.S. Constitution, while military law focuses on maintaining order and discipline within the armed forces, including specific regulations for military conduct and operations.
Application:
Constitutional law applies to all citizens, while military law only applies to members of the military.
Court System:
Constitutional law is adjudicated in civilian courts, whereas military law is handled through court-martial proceedings within the military justice system.
Flexibility with Rights:
While military members retain most constitutional rights, some may be limited or interpreted differently depending on the needs of the military, like freedom of speech or privacy rights.

Trump will use the Military on Immigrants, it’s going to be Marshall law. The military is going to be Judge, jury & lawyer. And going for families. Military Law is not the same as CONSTITUTIONAL LAW.
