This may be a step ahead for clearing the ground for Government Approved Test Centres. (GATC)

The Government of India has amended some provisions of the Legal Metrology (Packaged Commodities) Rules, 2011 which will come into effect from 1 April 2022. These amendments will have a cascading effect on the manufacturers, packers, and importers of pre-packaged commodities. The gist of the amendments and remarks are as under -
The basic purpose of the Packaged Commodities Rules is standardization in respect to quantity. Though these Rules are amended from time to time, except a few, this aspect was always regarded while effecting amendments. However, by bringing the amended rules into effect, the gross deviation is likely to be affected by the basic purpose of this Rules resulting defeat of this very basic purpose of the Rules.
Rule 4 (2) is added by renumbering. Since rule 5 is deleted, sub-rule (2) therein is added here for keeping the provision that ‘every package of the group for promotional offer to comply with the requirements of rule 6, live.
Rule 5 is deleted. As a result, the Second Schedule which specified certain commodities to be packed in specific quantities will be automatically deleted. This will result in the pre-packing of any commodity in any quantity. The industry is now free to pack commodities in any pack size. (This is contrary to the purpose of standardization)
Rule 6 (1)(d)- Now whether the commodity is manufactured or pre-packed indigenously or imported into India, only a month and year of manufacturing is required to be declared on the package. Earlier month and year of manufacturing or pre-packing or import was required to be declared. By this amendment, it will do away with the practice of pre-packing of old commodities eighter imported or otherwise to the latest date.
Rule 6 (1)(e) Now MRP can be declared in any form and in any amount in rupees or/and paise. However, it has to specify that MRP is the maximum price. And rounding of a rupee or fifty paise is also not required.
Rule 6 (11) New provision incorporating unit sale price of the commodity in a package. This might be because since there will not be any specified pack size and commodity can be in any quantity. This might be for facilitating consumers to compare the unit value of the identical commodity.
As per the amended provision, a declaration of the unit sale price of the pre-packed commodity is necessary. However, unlike earlier provisions, there is no express provision of the manner of declaring retail sale price of the commodity. For the commodity with net quantity of less than 1 kg, the unit sale price should be declared as "Rs.__ per g". and so on. The Rules, however, do not specify for writing/printing the qualifying words/clause as "Unit Sale Price". (This will put Industry to a great loss as almost every label is required to be changed)
Rule 13 (5) Instead of a declaration of symbol of the unit as N or U for commodity packed in number, the amended provision is wider for removal of the hardship of the industry and providing more scope.
The other proposed changes are in view of incorporating the related provisions of other enactments which have already been brought into effect.
