Abba Kyari drags FG to court

Detained Deputy Commissioner of Police, DCP, has dragged the Federal Government before a Federal High Court in Abuja challenging his continued detention by the National Drug Law Enforcement Agency (NDLEA).

In the suit marked FHC/ABJ/CS/182/22, Kyari who is currently on suspension from the Nigerian Police Force is seeking an order of court to immediately release him.

In the alternative, the suspended DCP, being held by the NDLEA over his alleged involvement in hard drug trafficking wants the court to admit him to bail in liberal conditions.

Justice Inyang Eden Ekwo is expected to take the ex-parte application filed along with the suit any moment today.

Justice Inyang Eden Ekwo of the Federal High Court in Abuja has refused to order the Federal Government to release the detained Deputy Commissioner of Police (DCP), Abba Kyari, from the custody of the National Drug Law Enforcement Agency (NDLEA).

The judge rather ordered that Kyari put the Federal Government on notice of the existence of the suit he instituted against it.

The suspended DCP had taken the Federal Government before the court, challenging his continued detention by the agency. In the suit marked FHC/ABJ/CS/182/22, Kyari sought an order of the court to immediately release him and in the alternative, the suspended DCP, who is being held by the NDLEA over his alleged involvement in hard drug trafficking, asked the court to admit him to bail in liberal conditions.

In an ex-parte application by his counsel, Cynthia Ikena, Kyari claimed to be suffering from diabetes and hypertension and needs urgent medical attention.

In a brief ruling, Justice Ekwo declined to order his immediate release but ordered him to put the respondent( FG), on notice. The judge ordered him to go and serve all processes he filed on the Federal Government.

Nigeria’s problems emanated from their earlier political leaders who failed to reestablish themselves after gaining independence in 1960.”

The FG lawyer after the court sitting in Abuja yesterday said Kanu denied being a member of the IPOB.

The news spread like wild fire.

Many compared Kanu to Peter who denied his master Jesus. But the allusion is inappropriate.

I don't want to delve into it.

When I saw the FG lawyer reeling out the denial, I smiled at his naivity and presumptuousness.

Kanu did not DENY being a member of the IPOB. No, he didn't.

He DENIED being a member of a PROSCRIBED group called IPOB.

Is this thing difficult to understand?

Would you have him admit he is a member of a proscribed group term terrorists?

Kanu is not a dullard.

The FG can't force Kanu to accept being a member of a terrorist group.

The IPOB is not a terrorist organization. The IPOB are neither Boko Haram nor Bandits.

The IPOB are not carrying out a jihad.

The IPOB are not forcing people to leave their native lands for them. The IPOB are not attacking crops, nor leading cattle to destroy people's farms.

The IPOB are simply asking for referendum.

The IPOB are demanding secession.

Self-determination is not a crime; it is a fundamental human right.

Kanu and the IPOB are seeking a separate State from the contraption called Nigeria.

If the IPOB is a terrorist organization, then Britain is a terrorist country because of Brexit.

And not just Britain.

Almost all known countries in the modern world are terrorists if the IPOB is a terrorist organization.

Self-determination is not a crime. It is the only thing Kanu and the IPOB are seeking.

When the opprobrious epithet of Proscription is removed, Kanu will not deny being a member of the IPOB.

In fact, Kanu is not just a member of the IPOB but the founder of the organization.
