Recently I was one of several hundred bodyworkers in the city served with a notice from the SF Dept. of Public Health stating that I needed to obtain a permit from their department in order to work as a massage therapist at my own practice.
I was told to cease operations immediately or face a fine of $1,000 per day.
I am state certified through California Massage Therapy Council (CAMTC) and licensed to practice in San Francisco at my home office. I have been practicing legally for almost 10 years.
State certification alone allows me to work anywhere in the state without having to obtain additional city permits but SF Dept. of Public Health seems to be circumventing the law.
For those who are curious, here is the exact law:
"The Massage Therapy Act, codified in California Business and Professions Code sections 460, 4600-4621, and Government Code section 51034, applies to all CAMTC applicants and certified massage professionals. Business and Professions Code section 460(a) generally provides that no city or county shall prohibit a person or group of persons certified by CAMTC from engaging in their business, occupation, or profession, or any portion of that business, occupation, or profession. Business and Professions Code section 460(b) generally provides that no city or county shall prohibit a person certified by CAMTC from engaging in any act or performing any procedure that falls within their professionally recognized scope of practice."
I want to let you know that I have joined the SF Massage Council to bring a solution to this matter. Over 200 self employed massage therapists in the city have been affected by this in the past week. I am letting you know to spread the word and also ask for your help.
If you know anyone in news/media who might interested in covering this story, please have them contact me.
